Website use – Using this website is conditional upon your acceptance and compliance with the Terms & Conditions set out below. By using this website, you are agreeing to our Terms and Conditions. Guardian Safety Pendants reserves the right to amend the Terms and Conditions at any time and without notice to you. If you use this website after any change we make, you are responsible to abide by the Terms and Conditions accordingly.
Product Availability – If we happen to be out of stock of an item you have ordered online, you will be notified and you may (a) request a different model, (b) wait for new stock to become available, or (c) request a full refund.
Prices – The cost of any Guardian Safety Pendants model includes SIM card activation and custom programming. The displayed price includes GST (if applicable). You are responsible for any taxes, duties or other liabilities imposed by any governmental agency for any product(s) you order from this website.
Best Price Guarantee – If you find another personal alarm for a better price, we’ll beat it by 5%.
The Best Price Guarantee is conditional on the following:
• The product is provided by an Australian company
• It is an identical model
• The Best Price Guarantee will beat the NORMAL PRICE, not the DISCOUNTED PRICE.
Example: normal price is $500, discounted orice is $400; we only beat the normal price
• The competitor’s product must come with two key services that we offer; 1) Fully programmed and setup by the seller, & 2) Lifetime phone support
• After a 2 year period, their ongoing costs must not be higher than GSP’s such that the difference in initial cost is made up by the ongoing costs.
Example: Competitor’s normal price is $400. Ongoing cost is $150/year. After 2 years, total cost is $400 + $300 = $700. With GSP, normal price is $519. Ongoing cost is as little as either $50/year or $70/year. Even with $70/year, after 2 years total cost is $519 + $140 = $659. The $400 + $150/year ongoing cost competitor does not qualify.
Delivery – We endeavor to post your order within 1-2 weeks after you provide us with the information needed to activate your SIM card and program your unit. If you have not received your order within 5 weeks of receiving the invoice from us, contact our office at (08) 6336 9448 or info@guardiansp.com.au. Guardian Safety Pendants will not be held liable for lost packages that are not claimed within 6 weeks of the dispatch date.

You are responsible for assuring that your product performs as expected when you receive your item(s). Users of a pacemaker should take caution when wearing personal alarms. Always consult your GP to discuss how your pacemaker may affect the personal alarm. If your pacemaker is new enough to allow you to have an MRI, personal alarms should not be a concern, however, it’s still best to consult with your local GP.
To the maximum extent permissible by applicable law, Guardian Safety Pendants and/or its distributors shall in no event be liable for any direct, indirect, punitive, personal injury or death, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use arising out of or in any way connected with the use or performance of the Guardian Safety Pendants and/or the phone service providers used in conjunction with the Guardian Safety Pendants. If you are dissatisfied with the Guardian Safety Pendants and/or any related services, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the Guardian Safety Pendants.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to:
• Cancel your service contract with us; and
• A refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Automatic Fall Detection Disclaimer – It is NOT recommended to test the fall alert function when the device is worn. If fall detection is on and you want to hear what happens when a fall alert is triggered, hold the device at CHEST HEIGHT over a soft surface (e.g. a carpeted area) and drop it. The alert will sound after a brief delay. Most of the time, when someone falls, they are not unconscious. While this may happen, it is always best to press and hold the SOS button in the event of a fall to be assured that the emergency contacts (or the Monitoring Company) are/is notified. Fall detection is particularly useful for those prone to blackouts or epileptic seizures. It’s easy to turn fall detection off or on. Call us and we’ll make the change for you.
NOTE: Fall detection is NOT 100% accurate; false alarms may occur. It’s also possible that a fall may not be detected.
Ongoing Costs – Our Personal Alarms require ongoing costs, such as professional monitoring and SIM card fees. These costs cover network usage, such as calling and texting, admin fees, and monitoring fees if relevant for products which are professionally monitored. Ideally, invoices for ongoing costs are emailed to the user, family member, friend, or person/company responsible for paying the invoice. Guardian Safety Pendants will attempt to send invoices via email as opposed to in the post to promote reduced paper usage. Posting an invoice in the mail as opposed to via email will incur a $5 fee. Information explaining this additional fee and a prompt to clients to provide an email address for the invoice will also be provided in the mail at the time each invoice is sent via the post. Guardian reserves the right to charge or waive this $5 fee.

Indemnity – The person using the Guardian Safety Pendants unit indemnifies all representatives and distributors of the Guardian Safety Pendants from and against all claims, lawsuits, including legal fees, and losses asserted against and alleged to be caused by the Guardian Safety Pendants. This includes any and all claims for contributory liability and/or subrogation. Indemnification and subrogation rights extends to include any and all third party beneficiaries of the Guardian Safety Pendants user. The product is not directed at, or intended for distribution to or for use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation, or any jurisdiction or country that would subject Guardian Safety Pendants or its licensees or affiliates to any registration requirement within such jurisdiction or country. The services and content are provided “as is” and without warranties of any kind, either express or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, which are hereby expressly disclaimed to the fullest extent permissible pursuant to applicable law. Guardian Safety Pendants shall not be responsible or liable to any user for any acts of fraud, theft, misappropriation, tampering, hacking, interception, piracy, misuse, misrepresentation, dissemination, or other illegal or unauthorised activities of third parties.
Product Limitations – Guardian Safety Pendants’ personal alarms’ (i.e. pendants, watches, etc.) are reliant on the cell phone service provider’s network coverage to make phone calls, to send SMS text messages and to transmit information regarding GPS positioning. These services may vary between providers and locations throughout the world. GPS location is often not available when the personal alarms are inside a building. Also, outdoor location performance can sometimes deliver inaccurate coordinates if the device is unable to get a fix on a minimum number of satellites. The accuracy of GPS positioning is determined by the availability of unobstructed line of sight to the available satellites. It is not a life saving device and cannot provide a guaranteed level of performance beyond what can be expected from technology of this kind. It can only perform as it should when correctly operated. If it does not call or text when it’s supposed to, get help with an alternate method. It is highly recommended that the user periodically test their personal alarm every 1-3 months by pressing and holding the SOS button. If family monitored, warn the emergency contacts first. Your emergency contacts should be people who are available to assist you. Choose contacts carefully.
Liability Limitation – Should any liability arise due to actions by Guardian Safety Pendants representatives, regardless of whether or not any loss, damage, or injury was caused or contributed by Guardian Safety Pendants’s negligence, such liability will not exceed the amount of $397. Guardian Safety Pendants representatives and its distributors make no assertions or assurances that its products will work at all times, nor are any Guardian Safety Pendants products designed to prevent injury(s) or loss. Guardian Safety Pendants is not responsible or liable for any injury, loss or damage caused by anyone responding or failing to respond to the user’s call for help. Guardian Safety Pendants representatives are not responsible or liable for any injury, loss or damage for the user’s failure to follow the instructions contained in the Guardian Safety Pendants user guide or owner’s manual, or for failure to recharge the Guardian Safety Pendants. To the fullest extent permissible by law , Guardian Safety Pendants shall not be responsible or liable to you or any third parties claiming through or under you under any circumstances for any indirect, consequential, special, incidental, punitive, or exemplary damages or losses, arising out of your use or inability to use the product, including but not limited to interruptions or delays in transmission, regardless of the type of claim or the nature of the cause of action, even if Guardian Safety Pendants has been advised of the possibility of damage or loss. To the fullest extent permissible by law, Guardian Safety Pendants’s maximum aggregate liability shall not exceed the amount that you have paid for the goods to which the liability relates. To the fullest extent permissible by law, if you are dissatisfied with the product, fulfilment of any order, do not agree with any part of this agreement or have any other dispute or claim with or against Guardian Safety Pendants, your sole and exclusive remedy is to discontinue using the product. Guardian Safety Pendants accepts no responsibility for any Electro Magnetic Pulse (EMP) that may or may not be generated by phone service providers regardless of whether such EMP damages or disables the user’s Guardian Safety Pendants device. The foregoing limitations shall apply notwithstanding any failure of essential purpose of any limited remedy, and to the extent applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, the foregoing limitation may not apply to you. Except in the case of Guardian Safety Pendants’s wilful misconduct or fraud, you understand and expressly agree that your use of the Guardian Safety Pendants product is at your sole risk and that to the extent permitted by law, you will be solely responsible for any damage to you, your property or any third party or their property arising from use of the product.
Shipping – Guardian advocates for ‘signature on delivery’ to maximise the likelihood of safe delivery. Clients may choose for their package to come with ‘authority to leave’ to safe the signature on delivery fee, however, such clients accept full responsibility for any lost or stolen packages. GSP waives any liability for such items. GSP shall not be responsible for shipping or fulfilment delays, the cancellation of any transaction or the unavailability of any product. GSP will not be held liable for lost packages that are not claimed within 6 weeks of the dispatch date.
Website Links – The Guardian Safety Pendants website includes links to other websites that are not controlled by Guardian Safety Pendants. We are not responsible for the accuracy of information on those linked sites.

Discounts – Vouchers cannot be used in conjunction with any other offer or discount. Only one discount can apply to a single order.

Media provided to Guardian Safety Pendants – Any media (for example, photos, videos) freely provided to Guardian Safety Pendants becomes their property to use and distribute. This includes media provided during competitions. If media is provided to Guardian Safety pendants with written stipulation surrounding its distribution (for example, the provider of such media has expressed their request that the media not be distributed), Guardian Safety Pendants must not publicly distribute such media.

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information collect may include: names, addresses, email addresses, and phone numbers.
This Personal Information is obtained in many ways including interviews, correspondence, by telephone, by email, via our website www.mobilealert.com.au, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We do not guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. Any and all confidential information we receive over the phone that is hand written on our end is electronically transferred to the afore-mentioned password-protected site and the hard copies are shredded. We do not share user’s personal information except when required by law, in which case, personal information may be disclosed without the user’s consent.
All information received on our Guardian Safety Pendants website is SSL secured and encrypted.
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. Safety Information
Device Safety
- The Guardian Safety Pendants is not submersible. It is recommended you DO NOT wear the unit while showering, however if you do take the unit into the shower, we recommend you place it into a zip-lock bag and hang it on a hook or place it onto a low ledge above drain level where you can easily get to it. Be aware that water infiltration may permanently disable or destroy this product.
- Switch off your Guardian Safety Pendants when instructed to turn off all mobile phones on commercial aircraft.
- Avoid using a damaged power cable. This may cause overheating or a potential fire hazard.
- Never use any chemical or detergent to clean the Guardian Safety Pendants. This may erode its surface.
- In order to eliminate the risk of electric shock, do not touch the ends of the power cable, charging plug or the metal parts on the inside of the charging cradle with wet or damp hands.
- Avoid direct prolonged exposure to sunlight and high temperatures to negate the potential of over-heating the battery, which may cause damage.
- It is recommended you DO NOT wear the Guardian Safety Pendants on a lanyard while sleeping.
Emergency and Disaster Management
- Personal alarms rely on several things to operate; a charged battery, an active SIM, and a cell signal.
- Guardian Safety Pendants aims to ensure that things we can help influence (i.e. a charged battery and an active SIM) are working in an emergency. Note that we have no control over cell signal strength, however, we recommend clients are aware of coverage in their local area (click here for Telstra coverage map).
- Guardian Safety Pendants helps ensure clients have a charged battery by programming low battery voice prompts, low battery notifications to emergency contacts, and power off notifications to emergency contacts.
- Guardian Safety Pendants helps ensure clients have an active SIM by recommending Guardian Telstra SIM cards which are managed by us and always remain active despite client usage.
- Guardian Safety Pendants helps ensure clients can connect to someone in an emergency, even if normal cell coverage is unavailable by recommending clients have 000 programmed as an emergency contact. This means when only emergency calls are available in a poor coverage area, the personal alarm will still be able to call 000.
- Guardian Safety Pendants helps ensure products are always working and connected by recommending clients tet their device regularly (as shown in user guides).

Return & Refund Policy
Personal Alarms
Should you request a refund, the amount refunded will be for the product and does not include the cost of the product setup. To qualify for a refund, you must contact us within the 30 day guarantee period. Once you have contacted us, you must post the personal alarm within 1 week. The personal alarm will be assessed in our office. If it is in working order, you will be refunded the product cost minus $50 for set up. The non-refundable portion of $50 covers the time and processes involved in setting up your customised product. Failure to return the product within the required timeframe or damages to the product may result in the disqualification of a refund or a partial refund.
Note: for Indigo orders (via geat2GO), they have their own internal policies. Please ensure to contact them (08 9381 0600) within 14 days of receiving your personal alarm to discuss how to proceed. They do not allow for change of minds and are strict to the 14 day limit.
Accessories
Return your item within 30 days and receive a full refund of the product. Damages to the product may result in disqualification of a refund or a partial refund.

Warranty Policy
The Guardian Safety Pendants are warrantied for one (1) year from the date of purchase when used under normal conditions, appropriately cared for and maintained.
At the discretion of Guardian Safety Pendants, repair or replacement may include new and/or refurbished parts up to the value of the unit being repaired or replaced.
The warranty does not apply if there is:
(1) evidence of water infiltration;
(2) damage to the recharge insertion point;
(3) power, electrical or voltage surge;
(4) damage caused by accident, excessive heat, abuse, *misuse, flood, fire, lightning, or earthquake.
* includes using the device in a way not intended for everyday use, such as, opening the casing to adjust the electronics, such as the SIM card
Do not return your Guardian Safety Pendants by post until you first call us to ascertain what the problem may be and we confirm that returning the unit is necessary. Australian Consumer Law may imply warranties or conditions or impose obligations upon Guardian Safety Pendants that cannot be excluded, restricted or modified.
This must be read subject to these statutory provisions. Under these provisions your rights as a consumer include statutory guarantees that goods supplied to you will be of acceptable quality and will be fit for any notified purpose.
To the extent that the applicable law does not permit the disclaimer of warranties, the product is warranted only to the minimum amount legally required.
